The purchase of commissioned work or prints does not entitle the purchaser to the copyrights of the image. The copyright always remains with the artist Kerry Clarke.

Kerry Clarke reserves the right to display any artwork produced on her website gallery, social media etc. Any client that does not wish to have their commissioned portrait displayed must notify the artist before work commences.

Deposits

Upon receiving the first 50% payment of the commissioned portrait, please note that 30% of this payment is a non- refundable deposit, which is required to reserve a place on the client waiting list. Time scales are always advised at the time of ordering. Portraits will not be deemed as ordered until the first 50% payment has been received.

Payments

After receiving the first 50% payment , the artist will commence work on the portrait in order to meet the dates/time scale previously discussed. Upon completion of the portrait, the artist will send you a photograph to ensure you are entirely happy with the portrait. After your approval you will be sent the remaining 50% final balance invoice. This must be paid in full prior to shipping. Payments can be paid via bank transfer (UK only), PayPal invoice or if preferred via my Etsy shop.

Cancellations

Clients have 3 days to cancel their order from the date of paying their first 50% payment. Cancellations can Only be made via email. Upon cancellation they will receive a full refund and lose their place on my waiting list.

If the clients request to cancel their order and the 3 days have passed since paying the first payment (50%), the full deposit amount (30%) will be retained as loss of business, to cover the artists time, administration, emails, mock ups and payment fees. Any additional payment made by the client will be refunded in full.

Changes and rejection of commissioned portraits

The client will receive a photograph of the completed portrait prior to paying the last 50% payment. They can contact the artist about any changes required, prior to final payment and shipping.

If the client is not happy with the changes/alterations made to the finished portrait, clients will receive a full refund minus the 30% taken for deposit.

If the portrait has been approved with final payment already made and portrait has been shipped. If the client is not happy with the portrait after receiving it or then wants changes to be made. The portrait must be returned to the artist for altering (The client must cover the necessary shipping charges both ways) or for a refund. (They will receive a full refund minus the 30% deposit after the portrait has been returned to the artist.)

Damage in transit

My portraits are packaged extremely well however in the unlikely event that damage occurs during transit, please send me a photograph of the damage immediately after receiving the package. The artwork must be returned to me and a new portrait will be drawn at no extra cost. The portrait will be added to my clients waiting list.

Lead time

I will provide an estimated completion date upon your enquiry. For specific dates (eg birthdays) I will always try my best to accommodate any special request.

Delivery

The artist ships portraits within the uk (free delivery) and the European union ( at a extra cost of £10). For any other country please enquire via the contact form or email for a specific delivery quote. Delivery time is approximately 1-5 days within the UK and 3-15 days outside the UK. I will not be held responsible for postal delays, strikes or natural disasters.

Privacy policy

Tax and import duty

All items for sale including commissions are not subject to value added tax. Payment of the import duty may be liable in some countries (please check with your local authority), this is the sole responsibility of the client.
